Terms of Service

1. Acceptance of Terms
By accessing or using MY Swift Audit ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users, including free (Freemium) and paid subscribers.
2. Description of Service
MY Swift Audit is an audit report generation tool designed specifically for Malaysian audit firms. The Service is provided as a Software-as-a-Service (SaaS) platform that helps users create audit reports by extracting and processing financial data from uploaded documents.
The Service uses artificial intelligence to assist with data extraction and report generation. While we strive for accuracy, users are solely responsible for reviewing and verifying all generated output before use.
3. Account Registration
To use the Service, you must create an account by providing accurate and complete information. You are responsible for:
- Maintaining the security of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access or security breach
- Ensuring your contact information remains current and accurate
4. Subscription Plans & Billing
MY Swift Audit offers the following subscription plans:
- Freemium: Free tier with 3 report generations, 14-day trial period, and 1 active company
- Starter: RM 30 per report, charged only on final download — unlimited drafts are free
- Elite: RM 500 per month for unlimited reports, team collaboration, and priority features
- Elite+: (Coming Soon) Everything in Elite plus the Working Papers module for full audit fieldwork coverage. Pricing to be announced.
By subscribing to a paid plan, you authorize MY Swift Audit to charge your payment method on a recurring basis. Elite subscription fees are charged in advance at the beginning of each billing period.
5. No Refund Policy ⚠️
All purchases are final. MY Swift Audit does not offer refunds, credits, or exchanges for any subscription fees or per-report charges once payment has been processed.
This includes but is not limited to: per-report download charges, partial billing periods, and Elite subscription months. If you have a billing error or were charged incorrectly, contact us at billing@myswiftaudit.com within 7 days and we will investigate.
We encourage all users to make use of the Freemium trial before upgrading to a paid plan.
6. Acceptable Use
You agree not to use the Service to:
- Generate fraudulent or misleading financial reports
- Misrepresent audit data or manipulate financial information
- Violate Malaysian law, including the Companies Act 2016, Financial Reporting Act 1997, or any other applicable regulations
- Upload malware, viruses, or any malicious code
- Attempt to gain unauthorized access to our systems or other users' accounts
- Use the Service in any way that could damage, disable, or impair the platform
7. Intellectual Property
The platform, user interface, underlying technology, and all related intellectual property are owned by MY Swift Audit. You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.
However, all reports generated using the Service belong to you and your firm. You retain full ownership and rights to the output created through the platform.
8. Limitation of Liability
The Service is provided "as is" without warranties of any kind, either express or implied. MY Swift Audit is not liable for:
- Errors or inaccuracies in generated reports
- Decisions made based on reports created using the Service
- Any damages resulting from use or inability to use the Service
- Loss of data due to technical failures or user error
Users are solely responsible for reviewing all output before submission to clients, regulators, or any third parties. The Service is a tool to assist with report generation, not a substitute for professional judgment.
To the fullest extent permitted by applicable law, MY Swift Audit shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, loss of revenue, loss of data, regulatory fines, or professional liability claims — arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.
In any event, our total cumulative liability to you for any claims arising out of or related to these Terms or the Service shall not exceed the total fees paid by you to MY Swift Audit in the twelve (12) months preceding the claim.
9. Account Termination
We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in conduct we deem harmful to the Service or other users. Upon termination:
- Your access to the Service will be immediately revoked
- You will not be entitled to any refund of subscription fees
- Your data may be deleted in accordance with our data retention policy
You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period.
10. Fair Use (Elite Plan)
The "unlimited" Elite plan is intended for use by a single audit firm and its staff (up to 5 user accounts per firm). The following uses are prohibited:
- Sharing account access with individuals outside your firm
- Reselling access to the Service to third parties
- Using the Service as a bureau to generate reports for clients outside your firm
- Automated or bulk processing that significantly exceeds normal firm usage patterns
We reserve the right to review account usage and take appropriate action if we detect violations of this fair use policy.
11. Prohibition of Resale & Third-Party Report Generation
You are strictly prohibited from using your MY Swift Audit account to generate audit reports on behalf of, or for sale to, other audit firms, companies, or any third parties.
Your account and subscription are licensed solely for use by your own firm for your own clients. The following activities constitute a violation of this policy and are outside our fair use terms:
- Selling, offering, or advertising report generation services to other audit firms using your MY Swift Audit account
- Generating reports on behalf of another firm, whether for compensation or otherwise
- Operating as a middleman, reseller, or service bureau using the platform
- Sublicensing, sharing, or granting access to your account for the benefit of any external party
Any violation of this clause may result in immediate account termination without refund, and we reserve the right to pursue further legal action to recover damages. If you are aware of any such misuse, please report it to legal@myswiftaudit.com.
12. Changes to Terms
We may update these Terms from time to time to reflect changes in our Service or legal requirements. We will provide notice of material changes via email or through the platform. Continued use of the Service after such notice constitutes your acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of Malaysia. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Malaysia. You consent to the exclusive jurisdiction and venue of Malaysian courts.
